Welcome to Elev8yourSoul! By using our website, mobile app, or any related services, you agree to the following Terms of Service. Please read them carefully before accessing or using the Site.

1. Eligibility

  • The Site is for users 18 or older.
  • You must not be subject to any trade restrictions or sanctions to use the Site.

2. Key Terms

  • Users: Individuals purchasing services on the platform.
  • Practitioners: Users who offer and perform services.
  • Orders: Agreements between Users and Practitioners, made after a purchase.

3. Account Creation and Security

  • You must provide accurate and updated information when registering.
  • You are responsible for all activities on your account and for maintaining the confidentiality of the email account credentials where we send the magic links for secure access.
  • Misuse of the Site, such as creating accounts for fraudulent purposes, is prohibited.

4. Service Offerings

  • Practitioners can offer services in various packages. Elev8yourSoul takes a 30% fee on the first transaction with a new user as a “Finder’s Fee” and 0% on repeat transactions.
  • Practitioners must provide high-quality services that match their Service description and images.

5. Payments

  • Payments are made upfront by Users and processed through Stripe. 
  • Practitioners are responsible for completing services as agreed. Repeated cancellations or service failures can affect their reputation and account status.

6. Cancellation, Refunds, and Rescheduling Policy

  • No Cancellations: Once a booking is made, cancellations are not allowed.
  • Rescheduling: If you need to reschedule, you may do so up to 48 hours before your scheduled session. Requests to reschedule made less than 48 hours before the session may not be accommodated.
  • No Refunds: As a general policy, Elev8yourSoul does not offer refunds once a service has been booked, except in cases of non-performance or at our sole discretion.

7. User Conduct

  • Users must maintain respectful communication. Any abusive or discriminatory behavior will result in account suspension.
  • Sharing personal contact details to conduct business outside of Elev8yourSoul is prohibited.

8. Reviews

  • Reviews are a core part of our platform. Soliciting false reviews or manipulating the review system is strictly forbidden.
  • Reviews that violate our terms may be removed.

9. Content and Intellectual Property

  • All content uploaded by users (text, images, video, etc.) is User Generated Content (UGC), and users are solely responsible for ensuring they own the rights to the content they upload.
  • Practitioners transfer ownership of intellectual property (e.g., work produced) to the User upon full payment.
  • Elev8yourSoul may use user-generated content for marketing purposes unless explicitly requested otherwise.

10. Data Use and Retention

  • Data Storage: We store your personal data to provide services and maintain records for legal and operational purposes. We retain personal information only as long as necessary to fulfill the purposes outlined in our Privacy Policy, including compliance with legal obligations, resolving disputes, and enforcing agreements.
  • Third-Party Sharing: We do not sell your personal information. However, in order to facilitate services, we may share limited data with trusted third-party providers who assist in operating the Site, such as payment processors and hosting services. These partners are obligated to protect your data and use it only for the services they provide.

11. Liability and Warranties

  • Elev8yourSoul does not guarantee the quality of services offered on the platform. Users assume the risk of engaging with Practitioners.
  • The Site is provided “as is” and “as available” without any warranties, except those required by law.

12. Dispute Resolution and Arbitration

  • Mediation Requirement: In the event of a dispute, we encourage Users and Practitioners to resolve the matter between each other. If the issue cannot be resolved through this process, either party may request mediation as a first step before pursuing further legal action.
  • Arbitration Clause: If mediation does not resolve the dispute, both parties agree to settle any claims through binding arbitration rather than litigation. The arbitration will be conducted in accordance with the rules of the American Arbitration Association (or equivalent in the relevant jurisdiction).
  • Governing Law: These Terms are governed by the laws of the United States and the state of Texas, without regard to conflict of law principles. Arbitration shall take place in Texas unless both parties agree to an alternative location.

13. Account Deactivation

  • Users may deactivate their accounts at any time. Any outstanding payments must still be fulfilled.
  • Elev8yourSoul reserves the right to suspend or deactivate accounts for violations of the Terms.

14. Modifications to the Terms

  • Elev8yourSoul may update these Terms. Continued use of the Site after changes means you accept the updated Terms.

15. Disputes and Legal Action

  • If disputes cannot be resolved via our support channels, they may be escalated to legal channels. Users are responsible for ensuring that their actions comply with all applicable laws.
